1a. Payment methods in the e-shop

You may choose from several payment methods:

• aa) Advance payment by invoice - Upon receipt of your order with an advance payment note, we will send you an invoice with a paying-in slip. We will dispatch the goods according to your order immediately after your payment has been received. • ab) Credit card (Mastercard, Visacard, Postcard, American Express) - You provide your card number and expiry date when ordering via the e-shop.
• ac) PayPal - You pay via your PayPal login
• ad) TWINT - You pay via the Twint app
• ae) Google Pay - You pay via Google Wallet
• af) Apple Pay - You pay via Apple Wallet
• ag) Heylight 12/24/36 month installment payment (up to max. CHF 15,000.00) - Direct payment processing via redirect to the Heylight website
• ah) Purchase on invoice (incl. installment payment) (up to max. CHF 3,000.00) - processed by CembraPay AG. The General Terms and Conditions and the privacy policy of CembraPay AG apply

CembraPay screening: To check whether we can offer you the CembraPay payment option, we (as the data controller) will forward your personal data (name, address, date of birth, contact details (email, telephone number) as well as IP address, proxy servers used, etc.) to CembraPay (as the data processor). CembraPay processes your data exclusively for the purpose of carrying out a credit check.

1b. Payment methods for shop purchases (store in 5430 Wettingen / 9500 Wil)

2. Shipping conditions for postal parcels

For postal parcel shipments up to 10kg, a transport cost share of CHF 9.90 or CHF 19.90 (from 10 to 30kg) is charged for advance payments or card payments. For bulky goods shipments (length from 100cm), additional costs are charged. For deliveries from 30kg via Cargo-Domizil, transport costs are calculated based on weight (unless included in the price) (see point 16).

Any permits required for access, or loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced to the customer separately.

Shipping is carried out by the Planzer parcel service - unless you specify otherwise, parcels will be deposited at the delivery address without a signature. If you do not wish for your parcel to be deposited, you must select the shipping method "Switzerland-wide shipping (registered)" during the order process (surcharge CHF 2.00). Without such a selection, any liability for potential loss of the parcel is completely excluded.

3. International shipments

Shipments abroad are only carried out against advance payment. Postage and fees are to be borne by the customer. For international orders, prices are charged excluding VAT. The respective national VAT must be paid upon delivery. Not all products from the Shark range can be delivered abroad. Please inquire about international shipping options in advance. No returns are accepted for international shipments.

4. Minimum order

Minimum order CHF 20.– (Switzerland) or + CHF 100.– (abroad).

5. Express

Express deliveries are only carried out upon request, and the costs are to be borne by the recipient.

6. Exchanges, complaints, and cancellations

Any notice of defects must reach the sender in writing within 14 days of receipt of the goods. For goods that are legitimately complained about, for example, due to a manufacturing or material defect, there is a claim for rectification of the defect, an exchange, or a corresponding credit note. The method of processing depends on the nature of the defect and the availability of the goods. Cash payment instead of a credit note is excluded.

Existing credit notes can be paid out at the customer's request. A processing fee of CHF 10.– will be charged for this.

In addition to statutory warranty rights, Shark Fitness AG grants a voluntary right of return or exchange of 14 days from receipt of the goods. This voluntary right of return or exchange only applies to unused, undamaged, complete, and original-packaged goods. The original packaging must not be taped directly, labeled, or otherwise damaged. All accessories and components must be returned in full.

Excluded from the voluntary right of return and exchange are:

• Reduced-price items, in particular promotional prices, sale prices, and exhibition prices
• Books, videos, DVDs, MCs, CDs, and USB storage media
• Sports nutrition and food
• all textiles for hygienic reasons
• all products or product components made of fabric or textile materials, in particular fabric balls, neck pillows, textile covers, slipcovers, upholstery covers, and similar items
• Items that have been individually modified or manufactured via orderable options
• Items that have been used, worn, soiled, damaged, or otherwise altered after delivery

Textiles are defined as not only clothing items but all products and product components made of textile materials. This includes in particular fabric balls, neck pillows, textile covers, slipcovers, upholstery covers, and similar textile products.

In the event of an exchange or cancellation for other reasons not based on a defect for which Shark Fitness AG is responsible, a processing fee of 10% of the invoice amount, but at least CHF 10.–, will be charged.

For cancellations of ordered items that contain the note "Delivery dates on request" on the website, a processing fee of 10% of the invoice amount, but at least CHF 10.–, will be charged without prior inquiry.

Any card fees already incurred or charged by the payment service provider, in particular for payments via PayPal or Saferpay, will not be refunded in the event of cancellations or refunds.

The costs for return shipments within the scope of the voluntary right of return or exchange are to be borne by the customer. Unpaid shipments will not be accepted. The goods must be sufficiently protected for return shipping and packed in a suitable shipping carton. In the event of damage to the goods or the original packaging due to insufficient packaging, a corresponding reduction in value may be charged.

The customer's statutory rights in the event of defective or incorrectly delivered goods remain unaffected by the above regulations.

7. Damages

Damages that occur during transit must be reported immediately to the delivering authority, e.g., the post office, freight forwarder, etc.

8. Warranty

All warranties are valid from the place of purchase (bring-in warranty), unless otherwise stated. Any returns or replacement deliveries under warranty are to be borne by the customer. Alternatively, warranty exchanges can be made at the Shark Fitness shops in Wettingen or Wil by prior arrangement.

II. General Terms and Conditions for Equipment Purchases

9. Warranty and warranty exclusions

Equipment warranty

The warranty is governed by the type of warranty specified for the respective product. This may include a warranty on labor and spare parts or a comprehensive warranty (labor, travel time, and spare parts up to a maximum total travel time of 4 hours within Switzerland).

Excluded from the warranty are consumables and wear parts such as upholstery, ropes, cables, batteries, V-belts, handlebar grips, adjustment mechanisms, and similar components. Also excluded are travel and labor times for the replacement of attachments, the replacement of which occurs under the warranty, provided that their replacement is reasonable for the customer.

Warranty claims expire if modifications, conversions, or repairs to the device are carried out independently or by persons not authorized by Shark Fitness. Only work carried out by an assembly team or service partner authorized by Shark Fitness remains covered by the warranty.

Setup, maintenance, transport, assembly, and installation are not part of the warranty services. Service costs for interventions outside of the warranty will be charged separately upon request.

Warranty exclusions

Excluded from the warranty are in particular:

1. Repairs or the replacement of wear parts.
2. Missing proof of purchase (e.g., purchase receipt, invoice, till receipt).
3. Damage resulting from improper or unintended use, failure to follow operating or training instructions, insufficient care or maintenance, corrosion or oxidation due to moisture or sweat, improper transport or storage, use outside the living area (e.g., garage, conservatory, balcony, sauna, indoor swimming pool, or similar damp environment), as well as intentional or negligent damage.
4. Minor defects that do not impair the function or usability of the device.
5. Damage caused by force majeure or improper transport.
6. Incorrect area of application, overuse, or misuse of the device. A warranty does not apply if the device is used outside the intended area of use (e.g., home use, light-institutional, or full-commercial use). The respective intended area of use can be found in the detailed warranty information in the "Warranty" tab of the corresponding device.

10. Specification changes, accessories, missing price information

Subject to changes in price, color, and technical specifications at any time. Errors in price and technical information excepted. Color deviations between the product and catalog/internet images are possible. Deviations in product illustrations are possible.

Pictured accessories such as bars, discs, dumbbells, handles, etc. are not included in the price unless listed as an accessory with the item.

Products without prices that can nevertheless be added to the shopping cart are not considered valid orders.

11. Delivery time

Ex stock, subject to prior sale; otherwise 1–10 weeks (depending on product - please inquire), subject to partial deliveries.

Products marked "available ex stock" may have a delivery time of several weeks when ordered with assembly and installation.

Products marked "available ex stock" may be sold out in the meantime. The status will not be adjusted if orders have already been placed with suppliers and the item is available.

Products with the availability status "Delivery date on request" are not available ex stock and availability must be requested.

12. Validity of an offer

Offers are valid for 10 days.

13. Price lists

All price lists printed before July 1, 2025, are no longer valid.

14. Credit notes

Credit notes are valid for 5 years from the date of issue.

15. Promotional prices

Definition of promotional prices: The promotional prices stated in the e-shop are promotional offers/special offers/sale offers/set offers. We reserve the right to change promotional prices at any time. Please also inquire about current promotions with our shop staff.

16. Definition of transport (from 30kg)

Transport (from 30kg) is understood as delivery by a freight forwarder to the sidewalk (ground level) without assembly and installation. Prerequisites are free access in front of the delivery building (truck, delivery van). Possible delivery times are Monday to Friday 08:00–12:00 and 13:00–16:00. Scheduling a fixed date is possible for an additional charge of CHF 80.--.

For transports not included in the price, the following freight rates apply: 30 to 50kg CHF 75.–, 51 to 100kg CHF 95.–, 101 to 750kg CHF 125.–. Any permits required for access, or loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced to the customer separately.

17. Definition of transport, assembly, and installation

Transport, assembly, and installation is understood as delivery, assembly, and setup by our assembly/installation team. Prerequisites are free access in front of the delivery building (truck/delivery van) and door/corridor/staircase widths of at least 80cm. Special installations are excluded (see point 18). Assembly includes the assembly and positioning of the device, subsequent testing, cleaning of the assembly area, and disposal of packaging material. The day and time of assembly and installation will be coordinated with the customer in advance. Any permits required for access, or loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced to the customer separately.

18. Special installations

Separate quotations apply for special installations. Special installations are defined as deliveries requiring more than 4 hours total travel time or over 300km total travel distance, special access routes such as spiral staircases, attics, the use of a crane, or mountain deliveries. Any permits required for access, or loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced to the customer separately.

19. Data protection article

The data stored by you is used exclusively for more convenient order processing so that you do not have to enter it again for your next purchase (cookies). Credit card numbers are not stored. Your data will neither be sold nor made accessible to third parties, except for any subcontractors for the purpose of delivery.

20. Place of jurisdiction

The place of jurisdiction is Wettingen.
