1a. Payment methods at e-shop

You can choose between several payment methods:

• aa) Advance payment via invoice - Upon receipt of your order with a prepayment note, we will send you an invoice with a payment slip. Immediately after receipt of your payment, we will ship the goods according to your order. • ab) Credit card (Mastercard, Visacard, Postcard, American Express) - When ordering via e-shop, you provide your card number and the expiry date.
• ac) PayPal - You pay via your PayPal login
• ad) TWINT - You pay via the Twint APP
• ae) Google Pay - You pay via Google Wallet
• af)   Apple Pay - You pay via Apple Wallet
• ag) Heylight 12/24/36 months installment payment (up to max. CHF 10'000.00) - Direct payment processing via forwarding to Heylight website
• ah) Purchase on account (including installment payments) (up to a maximum of CHF 3,000.00) – is processed by CembraPay AG. The General Terms and Conditions and the Privacy Policy of CembraPay AG apply.

CembraPay Screening: To determine whether we can offer you the CembraPay payment option, we (as the data controller) will forward your personal data (name, address, date of birth, contact details (email, telephone number), IP address, proxy servers used, etc.) to CembraPay (as the data processor). CembraPay will process your data exclusively for the purpose of conducting the credit check.

1b. Payment methods for in-store purchases (store in 5430 Wettingen / 9500 Wil)

2. Shipping conditions for postal parcels

For parcel shipments up to 2 kg, a transport fee of CHF 10.50 will be charged for advance payments or card payments, or CHF 13.50 for parcels up to 10 kg, or CHF 22.50 for parcels up to 30 kg. Additional charges apply for bulky goods (lengths over 100 cm). For deliveries of 30 kg or more, transport costs are calculated based on the weight (unless included in the price) (see section 16).

Fees for travel permits and loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced to the customer separately.

Shipping is handled by Planzer Parcel Service. Unless you specify otherwise, parcels will be left at the delivery address without a signature. If you do not wish to have them left at the delivery address, you must select the shipping method "Swiss-wide shipping (registered mail)" during the ordering process (additional charge of CHF 2.00). Without this option, liability for any lost parcels is completely excluded.

3. International shipments

Shipments abroad are only processed upon advance payment. Postage and fees are borne by the customer. For international orders, prices are charged exclusive of VAT. The applicable country's VAT must be paid upon delivery. Not all products from the Shark range can be shipped abroad. Please inquire about international shipping options in advance. Returns are not accepted for international shipments.

4. Minimum order

Minimum order CHF 20.– (Switzerland) or + CHF 100.– (abroad).

5. Express

Express deliveries are only made upon request and the costs are borne by the recipient.

6. Exchanges, complaints and cancellations

Any notification of defects must be received in writing by the sender within 14 days. Validly claimed goods (e.g., manufacturing defects) are eligible for exchange, but only for goods or a credit note, and within 14 days. A processing fee of CHF 10 will be charged for the transaction. Items with reduced prices (promotional prices/clearance prices/display prices), books, videos, DVDs, MCs, CDs, and USB drives, sports nutrition, and, for hygiene reasons, all textiles such as underwear and swimwear, as well as items that have been modified using optional extras, will be excluded from exchange. Only unused items in undamaged original packaging will be exchanged. For exchanges/cancellations for other reasons, a processing fee of 10% of the invoice amount, with a minimum of CHF 10, will be charged.

For cancellations of ordered items marked "Delivery dates on request" on the website, a processing fee of 10% of the invoice amount, with a minimum of CHF 10, will be charged without prior notice. Any card fees (PayPal/Saferpay) are non-refundable.

7. Damage

Damage that occurs during shipping must be reported immediately to the delivering authority, e.g. post office, freight forwarder, etc.

8. Warranty

All warranties are valid from the point of purchase (bring-in warranty), unless otherwise stated. Any returns or replacements under warranty are at the customer's expense. Alternatively, warranty replacements can be made at the Shark Fitness shops in Wettingen or Wil upon prior notice.

II. General Terms and Conditions for Equipment Purchase

9. Warranty and warranty exclusions

Device warranty

The warranty depends on the type of warranty specified for the respective product. This can include a warranty for labor and parts or a complete warranty (labor, travel time, and parts up to a maximum of 4 hours of total travel time within Switzerland).

Excluded from the warranty are consumables and wear parts such as padding, ropes, cables, batteries, V-belts, handlebar covers, adjustment mechanisms, and similar components. Also excluded are travel and labor costs for the replacement of attachments, which are covered by the warranty, provided their replacement is reasonable for the customer.

Warranty claims are void if modifications, alterations, or repairs to the equipment are performed independently or by persons not authorized by Shark Fitness. Only work performed by a Shark Fitness-authorized installation team or service partner remains covered by the warranty.

Assembly, maintenance, transport, assembly, and installation are not covered by the warranty. Service costs for work outside the warranty period will be billed separately upon request.

Warranty exclusions

The following are excluded from the guarantee:

1. Repairs or replacement of wearing parts.
2. Missing proof of purchase (e.g. receipt, sales slip, till receipt).
3. Damage resulting from improper or inappropriate use, failure to follow the operating or training instructions, inadequate care or maintenance, corrosion or oxidation due to moisture or perspiration, improper transport or storage, use outside of the living area (e.g. garage, conservatory, balcony, sauna, indoor swimming pool or similarly humid environment) as well as intentional or negligent damage.
4. Minor defects that do not affect the function or usability of the device.
5. Damage caused by force majeure or improper transport.
6. Incorrect use, excessive use, or misuse of the device. The warranty is void if the device is used outside of its intended use (e.g., home use, light institutional use, or fully commercial use). The intended use can be found in the detailed warranty information in the "Warranty" tab for the respective device.

10. Specification changes, accessories, missing price information

Prices, colors, and technical specifications are subject to change at any time. Errors in pricing and technical information are reserved. Color variations between the actual product and the catalog/online images are possible. Deviations from the product images are possible.

Pictured accessories such as bars, plates, dumbbells, handles, etc. are not included in the price unless listed as an accessory in the article.

Products without a price indication that can still be added to the shopping cart will not be considered valid orders.

11. Delivery time

Ex stock, subject to prior sale; otherwise 1–10 weeks (depending on product - please inquire), partial deliveries reserved.

Products marked "available from stock" may have a delivery time of several weeks if ordered with assembly and installation.

Products marked "available from stock" may temporarily become out of stock. This status will not be updated if orders have already been placed with suppliers and the item is available for delivery.

Products with availability indicated as "Delivery date on request" are not available from stock and availability must be requested.

Inquiries about delivery times for eShop orders only at info@sharkfitness.ch, stating the order number.

12. Validity of an offer

Offers are valid for 10 days.

13. Price lists

All price lists printed before July 1, 2025, will no longer be valid.

14. Credits

Credits are valid for 5 years from the date of issue.

15. Promotional prices

Definition of promotional prices: The promotional prices listed in the e-shop are promotional offers/special offers/special offers/set offers. Promotional prices are subject to change at any time. Please also ask our shop staff for information about current promotions.

16. Definition Transport (ab 30kg)

Transport (over 30 kg) is considered delivery by freight forwarder to the sidewalk (ground level), without assembly or installation. A clear access to the delivery building (truck, delivery van) is required. Possible delivery times are Monday to Friday, 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 4:00 p.m. A fixed delivery date can be arranged for an additional charge of CHF 80.

For transport not included in the price, the following freight charges apply: 30 to 50 kg CHF 75, 51 to 100 kg CHF 95, 101 to 750 kg CHF 125. Permits for travel and loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced separately to the customer.

17. Definition of transport, assembly and installation

Transport, assembly, and installation include delivery, assembly, and setup by the assembly/installation team. Requirements include clear access to the delivery building (truck/delivery van), and door/aisle/stairway widths of at least 80 cm. Special installations (see section 18) are excluded. Installation includes assembling and setting up the device, subsequent testing and cleaning of the installation area, as well as disposal of the packaging material. The date and time of assembly and installation will be agreed upon in advance with the customer. Permits for travel and loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be billed to the customer separately.

18. Special installations

Special installations are subject to separate quotes. Special installations include deliveries with a total travel time of over four hours or a total distance of over 300km, special access points such as spiral staircases, screed, the use of crane trucks, and mountain deliveries. Any permits required for travel and loading costs (train, cable car, electric vehicles, etc.) are not included in the delivery price and will be invoiced separately to the customer.

19. Data Protection Article

The data you save is used exclusively to simplify order processing, so you don't have to enter it again the next time you shop (cookies). Credit card numbers are not saved. Your data will neither be sold nor made available to third parties, except for possible subcontractors for delivery purposes.

20. Place of jurisdiction

Place of jurisdiction is Wettingen.
