I. General Terms and Conditions Shark Fitness AG
1a. Payment methods at e-shop
You can choose between two payment methods: aa) Prepayment by delivered invoice or ab) by credit card (Mastercard, Visacard, Postcard, American Express, TWINT)
aa) Prepayment options:
After receipt of your order with a note of prepayment, we will send you an invoice with a payment slip. Immediately after receipt of your payment we will send you the goods according to your order. ab) Credit cards:
You indicate your card number and expiry date when ordering via e-shop.
1b. Payment methods for shop purchases (shop in 5430 Wettingen / 9500 Wil):
You choose between two payment methods:
ba) cash payment or
bb) by credit card (Mastercard, Visacard, EC-Direct, Postcard, Amexco, Diners Club)
2. Shipping charges
For postal parcel deliveries up to 10kg, a transport charge of CHF 10.-, respectively CHF 15.- (from 10 to 20kg), respectively CHF 22.- (from 20 to 30kg) will be invoiced for prepayments or card payments. For cash on delivery deliveries see 1aa). For delivery from 30kg Cargo-Domicile the transport costs will be charged depending on the weight (except if included in the price) (p. point 16 and 17).
3. Shipments abroad
Consignments abroad will only be made against advance payment. Postage and fees shall be borne by the customer. Prices for foreign orders are exclusive of VAT. The respective country VAT must be paid upon delivery. Not all products from the Shark range can be delivered abroad. Please enquire about shipping options abroad in advance. No returns will be accepted for shipments abroad.
4. minimum order
Minimum order CHF 20.- (Switzerland) or + CHF 100.- (abroad).
5. Express
Express deliveries will only be made on request and the costs will be borne by the recipient.
6. Exchange, complaints and cancellations
A possible complaint must reach the sender in writing within 8 days. Justified complaints (e.g. manufacturing defects) are entitled to an exchange, but only against goods or a credit note and within 8 days. A processing fee of CHF 10.00 will be charged for the payment of credit notes. Excluded from exchange are items with reduced prices (promotion prices/sale prices/exhibition prices), books, videos, DVDs, MCs, CDs and USBs, sports nutrition and, for hygienic reasons, all textiles such as underwear and swimwear. Only unused items in undamaged original packaging will be exchanged. In case of exchange/cancellation for other reasons, a handling fee of 10% of the invoice amount, minimum CHF 10, will be charged.
For cancellations of ordered items that contain the note "Delivery dates on request" on the website, a handling fee of 10% of the invoice amount, minimum CHF 10.-- will be charged if no prior request has been made and the order is cancelled. Any card fees (PayPal/Saferpay) will not be refunded.
7. Damages
Damage occurring in transit must be reported immediately to the delivering authority, e.g. post office, railway, etc.
8. Warranty
All warranties are valid from the point of purchase unless otherwise stated. Any returns or replacements under warranty are at the customer's expense. Alternatively, warranty replacements can be made with advance notice at the Shark Fitness Shops in Wettingen or Wil.
II - GENERAL TERMS AND CONDITIONS OF PURCHASE
8. Equipment Warranty:
Definition for warranty on labour and spare parts: Labour and spare parts are eligible for warranty. Travel time remains excluded. Also excluded from the warranty are consumables such as upholstery, ropes & cables, etc.
Definition of complete guarantee: Guarantee on labour, spare parts and travel time (up to 4 hours total travel time within Switzerland). Consumables such as upholstery, ropes & cables, etc. are excluded from the guarantee.
Warranty services according to the explanations under paragraph Warranty. Assembly and maintenance are excluded from the guarantee. Service costs for use outside the warranty are available on request.
Transport, assembly and installation.
Transport, assembly and installation are not part of the warranty conditions.
9. Specification changes, accessories, missing price information:
Price, colour and technical specifications are subject to change at any time. Errors in price and technical specifications excepted. Colour deviations between the product and the catalogue/internet images are possible.
Accessories shown such as bars, discs, dumbbells, handles etc. are not included in the price unless listed as accessories in the article.
Products without prices but which can be added to the shopping cart are not considered valid orders.
10. Delivery time:
From stock, subject to prior sale; otherwise 1-10 weeks (depending on product - please ask), partial deliveries reserved.
Products with the indication "immediately available" may have a delivery time of several weeks when ordered with assembly and installation.
Products with the indication "immediately available" may be sold out in the meantime. Status will not be adjusted if orders have already been placed with suppliers and the item is available for delivery.
Products with the status "immediately available" may be sold out in the meantime.
Products with the indication of availability "on request / on order" are not available from stock and availability must be requested.

13. Credit notes
Credit notes are valid for 5 years from the date of issue
14. Catalogue prices and definitions:
Definition of promotional prices: the promotional prices stated in the e-shop, are promotional offers/special offers/set offers. Promotional prices are subject to change at any time. Please also check with our shop staff for current promotions.
--> Definition of transport: "Transport" included in the price is understood to be delivery by carrier to pavement (ground level) without assembly and installation. Prerequisites are free access in front of delivery building (lorry, delivery van). Possible delivery times Monday to Friday 08.00-12.00 and 13.00-16.00. Arrangement of fixed date possible for an additional charge of CHF 80.
--> Definition of transport, assembly and installation: "Transport, assembly and installation" included in the price is understood to be delivery, assembly and installation by Shark-Service. Prerequisites are free access in front of delivery building (lorry/delivery truck), door/aisle widths of at least 80cm and ground-level installations. Special installations are excluded (see point 15). The installation includes the assembly and installation of the unit, a subsequent testing and cleaning of the installation area, as well as the disposal of the packaging material. The day and time of assembly and installation will be agreed with the customer in advance.
15. Installation standard:
For general installation/assembly and transport costs, see items 15, 16 and 17.
16. Special installations:
Special installations are subject to separate quotations (e.g. deliveries to storeys, deliveries with a total travel time of more than 4 hours or a total travel distance of more than 300 km, special accesses such as spiral staircases, screeds, use of crane trucks, etc. or if more than one man is required). Permits for travel, loading costs (train, cable car, etc.) are not included in the delivery price and will be charged to the customer.
17. Assembly/transport of small equipment (benches, stands etc.) & multistations:
--> Transport to pavement by carrier (unassembled): up to 50kg CHF 75.-, 51to 100kg CHF 95.-, 101 to 750kg CHF 125.- (unless included in the price). --Transport to pavement by carrier (assembled) or transport and installation by Shark Service: depending on model (ask for a quote, unless included in the price).
--> Definition of transport: "Transport" included in the price is understood to be delivery by carrier to pavement (ground level) without assembly and installation. Prerequisites are free access in front of delivery building (small truck).
Possible delivery times Monday to Friday 08.00-12.00 and 13.00-16.00. Arrangement of fixed date possible for an additional charge of CHF 80.
--> Definition of transport and installation: "Transport and installation" included in the price is understood to be delivery, assembly and set-up by Shark-Service. Prerequisites are free access in front of delivery building, door/aisle widths of at least 80cm and ground level delivery. Excluded are special installations
18. Assembly/transport of cardio equipment:
Assembly only: CHF 25.- to CHF 150.- (depending on model). --> Transport to pavement only by carrier (unassembled): up to 50kg CHF 65.-, 51 to 100kg CHF 85.-, 101 to 750kg CHF 120.- (unless included in the price). --Transport to pavement by carrier (assembled) or transport and installation by Shark Service: depending on model (ask for a quote, unless included in the price).
19. Data protection articles:
The data stored by you will be used exclusively for a more comfortable order processing, so that you do not have to enter them again at the next purchase (cookies). Credit card numbers are not stored. Your data will neither be sold nor made accessible to third parties except for possible subcontractors for the purpose of delivery.
